Introduction

Silver Pine Software, LLC ("Silver Pine," "we," "us," or "our"), provides the KeepSafe.AI product and related goods and services. This Privacy Policy is provided to help you understand, with regard to our Services (as defined below), what personal information we collect, how we use it, secure it, and share it, and the choices available to you in accessing, updating, and correcting your personal information. Your use of our Services is subject to this Privacy Policy, our End User License Agreement ("Agreement"), and any other agreement(s) between you and Silver Pine regarding our Services; do not use our Services if you do not agree with what is set forth in our Privacy Policy, Agreement, or other agreement(s).

This Privacy Policy applies to: (i) our KeepSafe.AI websites, including https://keepsafe.ai/ (collectively, "Website") and (ii) any Silver Pine products or services that display this Privacy Policy, including without limitation our flagship KeepSafe.AI product (collectively, the "Services").

We are committed to complying with applicable laws, including applicable privacy laws. As part of our compliance efforts, we have evaluated various United States state-level comprehensive privacy laws and determined that Silver Pine is not currently subject to them. If that changes in the future, we will update this Privacy Policy. We have also evaluated privacy laws applicable to residents of Canada and Mexico and provide information on how we protect the personal information of those residents. Regardless of where you reside, we are providing you with several ways to control your personal information; these are detailed in the Your Options section below.

Finally, our Services are not intended for individuals under age 18 and we do not knowingly collect personal information from individuals under age 18. If you are under 18, please do not provide any information through our Services. If we learn that we collected or received personal information regarding an individual under age 18, without verification of parental consent, we will delete that information.

If you are an employer or other entity obtaining our Services on behalf of your employees or others, you are responsible for (a) disclosing your use of Silver Pine if required by applicable law and (b) obtaining all licenses, rights, clearances, consents, and approvals that may be required for you (and Silver Pine on your behalf) to collect, process, use, and store personal information and you represent and warrant that such collection, processing, usage, and storage will not violate any applicable law or any intellectual property, publicity, privacy, or other rights of any third parties.

Information We Collect

Silver Pine collects information as part of its business operations, to provide and improve the Services, to respond to requests, provide customer support, and to fulfill our legal and contractual obligations. The personal information we collect is never sold and is shared only as described in this Privacy Policy. You will generally provide this information directly, such as when you sign up for or populate your account in the KeepSafe.AI product. The following subsections provide more information on the information-collection topic.

Visitor Information

When you visit our Website, use our mobile application, or contact us to receive information about our Services, we collect certain information about you, which may include: name; email address; and phone number. We may also use surveys to solicit feedback that request your personal information, such as email address or other contact information.

Licensed User Information

We collect personal information from you when you sign up for our Services, update and/or populate your account by, for example, providing information about your assets in the KeepSafe.AI product, and in connection with customer-service requests. This information may include: name; email address; phone number; and authentication information (username and password). To the extent information you provide (e.g., physical addresses) are associated with a particular person, device, or household, that information may also constitute personal information.

Providing Additional Information

If you elect to provide other content or information containing personal information (e.g., photos, videos, audiovisual content, or written material), we will receive whatever information you elect to provide.

Information We Collect Automatically

When you use our Services, some information is collected automatically. This information may include: IP address; access times; browser type and language; and referral website. As is common with most websites, we also collect information about your usage and activity on our Services, including pages visited and resources accessed. We may aggregate this information to better understand our users, analyze trends, and improve our Services.

Sensitive Information

Sensitive personal information is not required to use our Services, and we do not wish to receive any such data. Sensitive personal information includes financial information, medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or information specifying the sex life or sexual orientation of an individual.

Cookies, Web Beacons, and Similar Tracking Technologies

We use only cookies necessary for Services functionality at this time. No tracking, marketing, or analytics cookies, web beacons, or similar technologies are used at this time. If we change our practices in the future, we will update this Privacy Policy.

Do Not Sell, Do Not Track, and Universal Opt-Out Mechanism

As noted above, we use only cookies necessary for Services functionality at this time. As such, our site does not respond to Do Not Sell or Do Not Track signals, or any global opt-out mechanism (such as the Global Privacy Control). You may still activate all of these through your browser or device settings so that, if we change our functionality in the future, our Services will receive your preferences and act accordingly.

How We Use Information

We do not sell your personal information, and we limit the use of your personal information to the purposes set forth in this Privacy Policy and as set forth in our EULA and other applicable agreements between you and Silver Pine. We may use your information to:

  • Operate and improve our Services;
  • Provide the Services that you request;
  • Respond to your feedback, comments, and questions, and provide customer support;
  • Contact you to request feedback about your experience with our Services or learn about your preferences and interests;
  • Send you information related to the Services, including confirmations, invoices, technical notices, updates, security alerts, and administrative messages;
  • Communicate with you about products and services offered by Silver Pine;
  • Collect anonymized and aggregated personal information for business purposes;
  • Customize or personalize your online experience (e.g. to pre-populate forms and display relevant content);
  • Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

When We Share Your Information

Third-Party Service Providers

We share your personal information with third parties to operate our business and deliver the Services to you. These third parties support us in the areas of finance, business administration, and computer hosting infrastructure and support. We also use third parties to support our compliance with legal or regulatory requirements, such as legal and tax advisors. When we share your personal information with a third party, we require that third party to protect that information consistent with this Privacy Policy and limit use of that information to performing the services they provide to us.

Company Successors; Insolvency

If we are involved in a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, any user information owned or controlled by us may be among the assets transferred to third parties as successors in interest. As part of this type of transaction, we reserve the right to transfer or assign your personal information to third parties. Other than to the extent ordered by a bankruptcy or other court, or as you may otherwise agree, the use and disclosure of all transferred user information will be subject to this Privacy Policy. Notwithstanding the foregoing, if we cease operating in an insolvency situation and there is no successor to our rights, we may securely delete your information as part of our liquidation process; provided that we will endeavor to provide reasonable advance notice through a message on the Website if that occurs.

We may disclose your information to government authorities or other third parties if any lawful circumstances arise, including when:

  • You have given us permission to share your information;
  • We are required to do so by law, or in response to a subpoena or court order;
  • We believe in our sole and absolute discretion that disclosure is reasonably necessary to protect against fraud, or to protect our property or other rights or those of other users of the Services, third parties, or the public at large; or
  • We believe that you have misused the Services or otherwise engaged in conduct that violates applicable laws, our EULA, or any other applicable agreements between you and Silver Pine.

There may be circumstances not covered by this Privacy Policy where we would like to share certain personal information about you. In those circumstances, we will let you know and obtain your consent.

How We Secure and Retain Your Information

We use reasonable administrative, technical, and physical safeguards to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. We will retain your personal information where we have an ongoing legitimate business need to do so, such as to provide our Services or to comply with applicable legal, tax, or accounting requirements. When we no longer have an ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, where your personal information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until it is deleted. In addition, we will retain your personal information for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Third-Party Sites and Services

Our Services contain links to third-party websites and platforms. For example, our KeepSafe.AI product's alerts will generally contain a link to the source of the alert (e.g., National Weather Service, local news station). This Privacy Policy does not apply to any third-party site, service, or product that does not display or link to this policy or that contains its own privacy policy, notice, or statement. We strongly recommend that you review the privacy policy of any website or platform that you visit so that you can stay informed as to how your information is collected, used, and shared.

Your Options

We understand you want to protect and control your personal information. This section details options you have regarding your personal information, including how you may review, update, and/or delete certain personal information.

Opting Out of Promotional Emails and Text Messages

You may opt out of marketing or promotional emails from us by (1) clicking the "Unsubscribe" or "Manage Subscriptions" (or similar) link in those emails or (2) emailing hello@keepsafe.ai. Please keep in mind that you may still receive transactional and service-related emails from us (such as emails related to your account, password reset requests, reminder e-mails you have requested, notices, and other similar communications that may be necessary for us to make the Services available to you or respond to your inquiries). You may opt out of receiving any text messages by replying "STOP."

Licensed Users

If you have a license to use the Services, you can log into the Services and manage (e.g., correct, update, etc.) your personal information. Alternatively, you may submit a request for assistance by emailing hello@keepsafe.ai with "Update My Account Information" in the subject line. Please note that there may be limits to what information can be deleted or amended and, in any event, we may require you to prove your authority to submit requests by email.

Other Options

In addition to the general options granted to you under this Privacy Policy, you also have the following options:

  • You may request access, correction, deletion, or updates to your personal information by emailing hello@keepsafe.ai;
  • You may object to our processing of your personal information, ask us to restrict processing of your personal information, or request portability of your personal information by contacting us by email at hello@keepsafe.ai;
  • If we collect and process your personal information with your consent, you can withdraw your consent at any time. Please note, however, that withdrawing your consent will not affect the lawfulness of any processing that we conducted prior to your withdrawal, nor will it affect the processing of your personal information where we have relied upon an alternate legal basis for the processing of your information; and
  • You may submit a complaint to your local data protection authority (e.g., state attorney general) about our collection and use of your personal information.

We do not currently make decisions based solely on automated processing (including profiling) that produces legal effects concerning you. If that changes, we will update this Privacy Policy to provide options associated with such processing.

We will respond to all personal-information-related requests that we receive in accordance with applicable law.

Additional Information for Canadian Residents

Residents of Canada and Mexico may have certain legal rights associated with their personal data ("Personal Data") beyond the generally applicable options set forth elsewhere in this Privacy Policy. If you are a Canadian or Mexican resident, this section provides you with additional information associated with those rights.

International Transfers

Silver Pine is headquartered in the United States and Personal Data will be transferred to, processed, and maintained on computer systems located in the United States. The United States is not currently a country the European Union has deemed "adequate" under applicable data protection laws. We may enter into data protection agreements or other legally approved mechanisms with our vendors to support compliance with applicable law, however. Specifically, we will take appropriate safeguards to require that Personal Data we process will remain protected in accordance with this Privacy Policy when transferred internationally, including when processed by third-party service providers and partners. The safeguards we will take may include one or more of the following: implementing the European Commission's Standard Contractual Clauses, relying on a third-party service provider's lawfully approved certification and/or compliance with the EU-U.S. Data Privacy Framework or the UK Extension to the EU-U.S. Data Privacy Framework, or Binding Corporate Rules.

We collect and use Personal Data based on our delivery of requested goods or services, legitimate business interest, or consent. More specifically, we will collect Personal Data from you: (1) where we have your consent, (2) where we need your Personal Data to perform a contract with you, (3) where we are a service provider for your employer or other entity contracting with Silver Pine on your behalf, (4) where we have a legal obligation to do so, or (5) where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms (such as processing for administrative purposes, product development or improvement, preventing fraud or criminal acts, or securing information that we collect). Onward Transfers

We engage third-party providers to provide system infrastructure, email, and tools that are necessary for running our business and Services. Such third parties act in accordance with the terms of our agreements, which include appropriate data-protection provisions. These agreements require that these third parties use your Personal Data only in a manner consistent with our instructions and applicable law.

Updates to this Policy

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. We will indicate the date it was last reviewed and/or updated at the top of the Privacy Policy. Your continued use of our Services after this Privacy Policy has been updated will be deemed your consent to the updated Privacy Policy.
